مروری بر مفهوم و ابعاد مختلف سقط جنین در اسناد بین المللی حقوق بشر

چکیده
مقدمه: سقط جنین یکی از موضوعات چالش‌برانگیز در بسیاری از جوامع است. امروزه از سقط جنین به‌عنوان معضل سلامت زنان،  موضوع اصلی سلامت عمومی و کیفیت مراقبت‌های بهداشتی و یکی از مهم‌ترین مسائل مطرح‌شده در حوزه حقوق باروری و جنسی زنان نام برده می‌شود. در رابطه با این مسئله که جنین انسان حق حیات دارد یا خیر،  اختلاف نظرهای فراوانی وجود دارد که به نوبه خود به اختلاف آرا در خصوص جواز یا عدم جواز سقط جنین منجر شده است. لذا این مطالعه با هدف مروری بر ابعاد مختلف سقط جنین در اسناد بین‌المللی حقوق بشر انجام شد.
مواد و روش‌ها: در این مطالعه مروری،  مرور مستندات بدون محدودیت زمانی و با جست‌وجو در پایگاه‌های اطلاعاتی PubMed، Scopus، Magiran، SID، Google Scholar و وب‌سایت سازمان‌های بین‌المللی WHO، Center for Reproductive Right، United Nations IPPF، CRR و UNFPA با استفاده از کلیدواژه‌های سقط جنین،  حقوق بشر،  حقوق زنان و حقوق کودکان انجام و اعلامیه‌ها و کنوانسیون‌های مرتبط با سقط جنین بررسی شد.
یافته‌ها: در بسیاری از اسناد بین‌المللی ازجمله اعلامیه جهانی حقوق بشر،  میثاق حقوق مدنی و سیاسی،  کنوانسیون حقوق کودک،  کنوانسیون اروپایی حقوق بشر،  کنوانسیون آمریکایی حقوق بشر،  کنوانسیون‌های چهارگانه ژنو،  اعلامیه حقوق بشر در اسلام و اعلامیه قاهره درباره حقوق بشر به نحو بارزی به حمایت از حقوق بشر و حق حیات پرداخته شده و سقط غیرقانونی جنین تجاوز به حق حیات یک جنین بیان شده است.
نتیجه‌گیری: هرچند در اغلب اسناد بین‌المللی مربوط به حقوق بشر به‌طور صریح به مسئله سقط جنین پرداخته نشده است،  با استناد به حق حیات که در بسیاری از اسناد بین‌المللی به آن اشاره شده است،  موضوع حق جنین برای زندگی قابل استنباط است.
